NOBLE, Okla. — An Oklahoma family has filed suit against BNSF Railway, saying the railway is at fault for the death of a family member, who died of a heart attack when emergency vehicles were unable to respond because a stopped train blocked the only entrance to their street.
KFOR-TV reports Larry Gene Byrd died of the heart attack in September 2020. A lawsuit filed by attorney Timothy Gaarder, representing the Byrd family, claims that when emergency vehicles tried to respond the incident, police asked if the train, which had been stopped for two hours, could be moved, and that a crew member said no, then “closed the locomotive window and would not respond to further questions.”
The city of Noble has subsequently opened up another route to the street involved.
A BNSF representative told the station it could not comment on pending litigation.
